The civil society`s freedom to participate in safeguarding democratic governance is getting limited, as indicated by several facts. First, there is the criminalisation of civil society who exercise their right to information and critical expression of a public policy. Second, the lack of protection for data security and civil society who exercise the right to information and expression. Finally, there is excessive and arbitrary use of force and authority against the right to assemble and organize. In this case, it is necessary to strengthen understanding related to restorative justice which can provide an alternative to imprisonment. Restorative justice has been implemented through various government policies and programs, such as the Juvenile Criminal Justice System (SPPA). However, there is no restorative justice policy direction for cases related to the right to information, the right to organize, the right to an opinion and the right to assemble.
Conduct studies related to restorative justice implementation in various institutions such as the Police, the Supreme Court, and the Attorney General`s Office.
This commitment supports the realisation of more transparent restorative justice so that the community gets their rights in every judicial process.
This commitment is in line with the Open Government values, namely participation, as the CSOs` involvement in the process of compiling studies related to restorative justice.
This commitment will support the 16th SDGs Goal of Strengthening Inclusive and Peaceful Communities for Sustainable Development, Providing Access to Justice for All, and Building Effective, Accountable and Inclusive Institutions at All Levels. Specifically, target 16.3 to encourage the rule of law at the national level and internationally and ensure equal access to justice for all. In addition, this commitment is following the 2020-2024 RPJMN, page 272, regarding increasing access to justice.
